Procedure for Granting Citizenship

An application for granting citizenship of the Slovak Republic is processed and decided on by the Ministry of Interior of the Slovak Republic according to the Act No. 40/1993 Coll. on Citizenship of the Slovak Republic.

Who receives the applications

The application for granting citizenship of the Slovak Republic, however, has to be submitted in person either at the District Office at the regional seat (Department of Internal Administration) according to the place of permanent or last permanent residence in the territory of the Slovak Republic or at the diplomatic mission or consular office of the Slovak Republic abroad.

When submitting the application, an applicant who has already reached 14 years of age also has to fill in ,the “Questionnaire of an applicant for granting citizenship of the Slovak Republic” which is issued by the Ministry of Interior of the SR.

The questionnaire of an applicant who has not yet reached 18 years of age must be signed by the applicant’s parents as well. If it is signed by only one of the parents, it is necessary to attach consent of the second parent with officially certified signature.

When filling in the questionnaire, the authority which is receiving the application verifies through an interview whether the applicant has sufficient knowledge of the Slovak language. The knowledge of Slovak language is verified in a manner adequate to the applicant’s health condition (more details are available in the article “Conditions for granting citizenship of the Slovak Republic”).

The office which received the application will subsequently send the complete applicant’s file together with opinion of the competent police department to the Ministry of Interior of the Slovak Republic to make a decision.

Deciding on application and time limit for its processing

The Ministry of Interior of the Slovak Republic which is then considering the application may also invite the applicant for personal interview mainly for the purpose of explaining some facts concerning his/her person.

If all conditions required by the law are fulfilled, the Ministry of Interior of the Slovak Republic may – but does not have to – grant citizenship to the applicant. In the decision process, the Ministry takes into account interests of the Slovak Republic, particularly from the point of view of state security, internal law and order, foreign policy interests, commitments of the Slovak Republic to third countries, social-economic situation, as well as opinions of the state authorities concerned and the Police Forces.

The Ministry will decide on the application for granting citizenship of the Slovak Republic within 24 months from delivery of the application for granting citizenship of the Slovak Republic to the Ministry at the latest. If an opinion of other state authorities is needed for making a decision and the decision is dependent on them, the proceedings are suspended and the time limit does not lapse.

The moment of obtaining citizenship

The citizenship of the Slovak Republic is acquired by collecting the Certificate on Granting the Citizenship of the Slovak Republic. The Certificate is handed over to the applicant by the District Office at the regional seat, diplomatic mission or consular office of the Slovak Republic after making the Slovak citizenship pledge.

Making a citizenship pledge is a precondition for gaining the citizenship of the Slovak Republic. The pledge is not made by children younger than 14 years of age; persons whose health condition does not allow them to do so; and persons who were deprived of legal capacity. The pledge is made to the head of District Office at the regional seat, ambassador, consul or person authorised by them.

TEXT OF THE PLEDGE

I pledge upon my honour and conscience that I will be loyal to the Slovak Republic, I will abide by the Constitution of the Slovak Republic, constitutional laws, laws and other generally binding legislation and I will duly discharge all duties of the citizen of the Slovak Republic.

 

If the applicant, without providing a serious reason, does not collect the document on granting the citizenship of the Slovak Republic within six months from the delivery of written notification, the Ministry will cease the proceedings. The decision on cessation of proceedings will be recorded in the file and the applicant will be notified accordingly.
