Conditions of trade operation

Each applicant for a Trade License must meet general and specific conditions for pursuing a trade.

General conditions of trade operation for natural persons, which must be met at all times, are:

Specific conditions for trade operation must be met depending on the type of business.

Special conditions are professional qualification or other qualifications for a trade. Professional qualification must be proved in case of regulated or craft trades. In case of regulated trades the professional qualification needs to be proved by a certificate proving a specific education or training in the relevant field. In case of craft trades the professional qualification needs to be proven by a certificate of competed education and the length of experience in the relevant field. Professional qualification may be proved by submitting the recognition of professional experience or the recognition of professional qualification. In case that an applicant does not meet the specific conditions for conducting the trade, he/she must appoint an authorized representative, who meets the conditions.

 

AUTHORIZED REPRESENTATIVE

In case that an applicant does not meet the specific conditions for conducting the trade, he/she must appoint an authorized representative. The authorized representative needs to have a temporary or permanent residence in Slovakia and must meet both general and specific conditions for conducting a trade. Furthermore, the entrepreneur must employ the authorized representative, which means he/she needs to conclude a contract of employment, pay the authorized representative at least a minimum wage, pay taxes, as well as health and social insurance contributions. However, this shall not apply in case the authorized representative is entrepreneur´s spouse, sibling or direct relative (all ancestors or descendants).

The Trade Licensing Office shall be notified of appointment of an authorized representative as well as cancellation of his function within 15 days.
