Who does not need a work permit or confirmation?

In Slovakia, you may become employed without a work permit, confirmation on the possibility to fill in a vacancy, or confirmation on the possibility to fill in a vacancy which corresponds to a highly qualified employment if:
- You were granted permanent residence in the territory of SR,
- You were granted temporary residence of a third country national with a long-term residence in another EU Member State, after 12 months from the beginning of the stay in the territory of SR,
- You were granted a temporary residence for the purpose of a family reunion,
- after 9 months of continuous residence in the territory of SR from being granted temporary residence for the purpose of family reunion,
- if you are a family member of a Blue Card holder,
- if you are a family member of a person sent to the SR as part of an intra-corporate transfer (ICT),
- if you are a family member of a third-country national with a temporary residence for the purpose of research and development, or
- if you are a family member of a person who works in the SR on the basis of mobility as an employee or researcher,
- You are a family member of an EU/Slovak national and you are entitled to reside in the territory of SR,
- You were granted temporary residence for the purpose of studies or national visa in the interest of Slovakia as a scholarship holder if your work does not exceed 40 hours per month if you are a high school pupil or 80 hours per week if you are a university student,
- If you were granted temporary residence for the purpose of research and development and
- you perform research or development on the basis of a hosting agreement or
- your pedagogical activity in employment relations does not exceed 50 days in one calendar year in total,
- You were granted temporary residence as a third-country national with the acknowledged status of a Slovak Living Abroad,
- You are an asylum seeker and your employment is possible under special regulations,
- You were granted asylum,
- You were granted subsidiary protection,
- You were granted temporary shelter (protection),
- If your employment relation or secondment does not exceed 30 days in one calendar year and
- you are a teacher, academic employee, university teacher, scientist,
- research or development worker participating in a professional scientific event or
- a performing artist taking part in the artistic event,
- On the basis of a business contract you secure delivery of goods or services, or you deliver such goods or services or you carry out installation works, warranty services and repairs, work related to system setup of production facilities, programming work or professional training if your employment relation or secondment does not exceed 90 days in one calendar year,
- You are accepted for employment relations based on an international treaty binding for the SR which stipulates that a work permit is not required for acceptance of a third-country national into an employment relationship,
- You are a family member of a diplomatic mission member, of an employee of a consular office, or of an employee of an intergovernmental organization based in the territory of the Slovak Republic, provided the international treaty made on behalf of the Government of the Slovak Republic guarantees reciprocity,
- You are a member of a rescue unit and provide assistance on the basis of the interstate treaty on mutual assistance in the mitigation of the effects of accidents and natural disasters and in the cases of humanitarian assistance,
- You are a member of the armed forces or of a civilian unit of the armed forces of a dispatching state,
- You are performing professional practice or professional training under special regulations in schools or school facilities,
- You have successfully completed your secondary school or university studies in SR,
- You are under 26 years of age and you will be employed in occasional and time-limited work within the exchange programs between schools or within youth programs or education programs, in which Slovakia participates,
- You were dispatched by an employer with a registered seat in an EU Member State within the provision of services provided by such employer,
- You are a partner in a company, or a statutory body of a company, or a member of a statutory body of a company that performs activities on behalf of the company that was provided investment aid, by performing activities, during a period for which the decision on the approval of the investment aid was issued for,
- For a company that was provided investment aid, by performing activities, you secure delivery of goods or services, or you deliver such goods or services or you carry out installation works, warranty services and repairs, work related to system setup of production facilities, programming work or professional training, during a period for which the decision on the approval of the investment aid was issued for,
- You are employed in an international transport company and posted to perform work by a foreign employer,
- You perform an activity for a legal person who has been issued a significant investment certificate, and
- you manage such a legal person or its organizational unit or
- you have exceptional professional knowledge, skills, abilities or know-how that are necessary for running a company, research techniques or management if performing of this activity does not exceed a total of 90 days per calendar year,
- If you are accredited in the media,
- Your tolerated residence has been extended because you were a victim of human trafficking,
- You were granted tolerated residence due to respect for your private and family life,
- You were granted tolerated residence due to the fact you were illegally employed under particularly exploitative working conditions or if your presence in the territory of Slovakia is inevitable for the purpose of criminal proceedings,
- You perform clerical activities on behalf of a registered church or religious society,
- You were granted a national visa and
- the Working Holiday Programme approved by the Government of the SR applies to you,
- you participate in the implementation of a film project on the territory of the Slovak Republic,
- it is in the interest of the SR approved by the Government of the SR,
- You are temporarily working in Slovakia on the basis of mobility
- from the employer in an EU member state as part of an intra-corporate transfer (ICT), or
- you carry out research and development on the basis of a hosting agreement or if your teaching activity does not exceed a total of 50 hours in a calendar year,
- Your work at all employers will not exceed 80 hours per month if you are a university student who stays in the SR on the basis of mobility,
- You provide professional training for the business service centre and the duration of your employment relationship with the business service centre does not exceed a total of 90 days in a calendar year,
- you have applied for the renewal of a temporary residence allowing you to be employed in Slovakia sufficiently in advance of the expiry of its validity, in the period from the expiry of the validity of this temporary residence until the final conclusion of the procedure for renewal of the temporary residence; sufficient time in advance shall be understood as a period of time corresponding at least to the length of the deadline for the decision on the application for the renewal of the temporary residence pursuant to the Act on the Residence of Foreigners.
These are usually cases where you can work in Slovakia on the basis of a residence that you have already been granted (e.g. permanent residence, a temporary residence for the purpose of study, etc.), or short-term jobs/postings in which a temporary residence in Slovakia up to 90 days not required.
In some cases, it is necessary to obtain a temporary residence for the purpose of employment. As it is not necessary to obtain a special work permit or the consent of the Labour Office, in these cases obtaining a temporary residence permit for the purpose of employment does not depend on the situation in the labour market.
In all these cases you can perform work within an employment relationship (contract of employment) or you may also be employed on the basis of an agreement performed out of the employment relationship.
