The employment of a third-country national in shortage occupation without a vacancy notice may be used only by an employer employing less than 30% of the third-country nationals on the date of the application for temporary residence for employment. An employee of the Labor Office, upon receipt of a request for confirmation on the possibility to fill in a vacancy by the police department, contacts the employer by telephone and asks him to submit the affidavit (Annex 11)
